HIGHEST COURT TO HEAR BUS ROUTE APPEAL
Major Doubt over Bus Route
Local woman Viv Morge today won a major victory in the Supreme Courtin London, the highest Court in the Country, when she was given permission to take her appeal to the Supreme Court.
Her challenge to Hampshire County Council over the proposed bus route along the old railway line between Fareham and Gosport will now be heard by five Judges in the Supreme Court.
The Court ordered that the case should be heard as soon as possible.
Her solicitor, Graeme Swain of Swain & Co solicitors said, “This is a huge victory. The case will now be heard in the Supreme Court and could yet be referred to the European Court.
The case is important locally but the legal issues in the case are also of National importance.”
The case involves complex arguments about what is meant by disturbance of habitats for protected species.
Graeme Swain said, “Both sides agreed that the Court of Appeal was wrong in its analysis.
I do not see how it can be appropriate to do any work on the scheme between now and the hearing. The issues have to be determined by the Supreme Court and possibly the European Court”.
Mrs Morge has called for the work to stop and for no money to be spent on the scheme until the legal issues have been dealt with by the Court.
The decision by the Supreme Court raises issues in relation to the current phase of the scheme but also a future phase that is proposed.
