Swain and Co prevent repossession

Shelter has today released a report on the number of home owners at risk of repossession.

The report looked at possession claims from April 2011-March 2012, identifying local areas as “hotspots” in the south coast.  Possession claims are applications by lenders to the courts to take possession of a person’s home, the first step to obtaining a possession order.

In the South East Region Portsmouth was listed 8th, Gosport was listed 9th and Havant listed 10th in the region, indicating a high rate of claims for possession in our region. However, Fareham was at the other end of the spectrum in 52nd place.

The figures show that Portsmouth has a 3.85 rate of claims per 1000 people, Gosport 3.78 and Havant 3.65.

Yet by no means are these figures the worst in England, Portsmouth was only 99th in the entire country and the worst was Barking and Dagenham with a rate of possession claims of 8.44 per 1000.

Swain & Co.’s specialist housing solicitors have been attending the court desk at Portsmouth County Court, which is the court for claims for possession for people residing in Portsmouth, Gosport and Fareham, since July 2011.

In November 2011 we did some of our own research of how many people facing repossession and eviction (through mortgage and rent arrears) from their homes we had assisted at court between July 2011 and November 2011. We calculated the following figures from the people we represented.


We helped 206 people and out of those 206:-


7 were adjourned – 3 %

53 were adjourned fixed period – 26%

22 were adjourned on terms – 11%

12 were dismissed – 6%

11 were other – 5%

24 outright order – 12%

1 was a postponed possession order – 0.4%

24 were stayed suspended – 12%

52 were suspended possession orders – 25%


This therefore shows getting advice can help; we managed to assist in keeping 82% of people in their homes, preventing repossessions.
