Discrimination
Discrimination is unlawful, despicable and we are committed to combating it.
Discrimination towards or against a person or group means treatment or consideration based on something other than individual merit. It is usually associated with prejudice.
We can advise in cases of race, age, disability and sex discrimination.
We can advise whether you have a claim for compensation or for a declaration of unlawful treatment.
The Prison Service is a ‘public authority’ and it is unlawful for a public authority to discriminate against you either directly or indirectly by treating you less favourably than any other person because you are of different race, colour, nationality or have a different ethnic or national origin than any other person.
Equally, it is unlawful to discriminate against you because of your religious beliefs.
All prison service policies, functions and services are included, so whether you suspect discrimination has occurred in matters concerning adjudications, applications for temporary leave, matters of security, transfer applications, re-categorisation decisions or a general policy of the prison service – seek advice immediately.
Claims have to be dealt within 6 months of the date of the actual incident. There is a strict deadline so don’t delay.
Swain & Co has expertise in a wide range of Discrimination Claims and Legal Aid is available for such claims.
We are also experts in relations to Human Rights and Civil Liberties.
