There is growing backlash to the government’s plans on curbing whiplash claims. Not in the principle of curbing the fraudulent cases, as fraud can never be excused, but more to the fact that the government appear to be just giving the insurance industry what they want.
The statistics used announced that whiplash claims from road traffic accidents are adding £90 to everyone premiums, and the measures the government want to use will reduce costs to insurers. They will then urge the insurance companies to pass on the savings. However, Swain & Co.’s specialist personal injury team cannot fail to be sceptical of this, and think that these savings in costs to insurers may well not be passed on victims of injury from road traffic accidents.
We agree that fraudulent claims are damaging to all who have motor insurance, however we must maintain access to justice for victims of road traffic accidents that are not their fault.
The most concerning point is that despite the introduction of the road traffic accident portal in 2010, which is estimated to have saved the insurance industry £500million in legal cost, insurance premiums have been increasing above the rate of inflation.
There is not one miracle solution to the rise in insurance premiums, but rather a culmination of a variety of factors. These all need to be addressed rather than solely focusing on personal injury claims where people have been injured through the negligence of others.
If you have suffered an injury that was not your fault, either in a road traffic accident, at work or from a trip or fall, you could be entitled to compensation.
