Community Care
No-win No-fee arrangements
Specialists in community care cases
Our clients include people who need or receive help from Social Services and the NHS across a wide variety of matters including:
Increases in population are already having considerable consequences for public services. Together with the public spending cuts, which seem to be slowly but surely eating away at services and support for the elderly, decisions are being made by Local Authorities that impact on an individual’s quality of life.
“At Swain & Co, we deal mainly with personal welfare matters and have the skills and experience to challenge Local Authority decisions or to present someone’s community care needs to a decision maker, to increase the chances of successfully obtaining the right support.”
Our team has specialisms in both public law challenges (Judicial Review) and in challenges under the Mental Capacity Act 2005, including Deprivation of Liberty Safeguards (DOLS) challenges.
If you think a Local Authority has made a decision relating to an individual that was based on incorrect information, did not follow proper procedures, was unlawful or just simply unreasonable or irrational, we can assist. We can assist in making a complaint to the relevant authority, or provide advice in relation to challenging that decision by way of Judicial Review or applying to the Court of Protection for a decision. Please contact a member of our team for further information.
We recognise that the right advice makes a real difference to the quality of life of a vulnerable person as well as reassuring their family and carers.
We will advise about the ways in which your matter may be funded including Legal Aid (Public Funding) and “No Win No Fee” arrangements. Lasting Powers of Attorney are offered on a fixed fee basis. Please contact Southampton or Havant office for further details.
Home or Hospital visits will be arranged where necessary.
We have fostered strong relationships with local care providers and local advocacy groups. Where it seems more appropriate, we will sign post you to the relevant organisation. It is not always a Solicitor that you need at the very beginning. We would be happy to discuss any concerns or potential issues, to determine who would be best to help you.
These are some of the organisations we talk to on a regular basis:
