Experienced lawyers who handle birth abnormalities claims

Birth abnormalities can occur due to complications, which arise during both pregnancy and delivery, and these problems may result in temporary or permanent injury to a baby. In some cases there is also injury to the mother. It is sometimes possible to make a clinical negligence claim when an abnormality has been ‘missed’ by healthcare professionals.

Birth abnormalities can be described as an abnormality present at birth which results in physical or mental disability. These can include but are not limited to, problems with limbs, heart and spinal cord. Other abnormalities commonly observed include those affecting the face such as cleft lip and palate.

The use of sophisticated ultrasound scanning has made the detection of birth defects prior to delivery a lot easier but this is dependent upon the ultra-sonographer performing the scan correctly.  If performed correctly it can detect many abnormalities before birth.

If a diagnosable birth defect is not diagnosed prior to birth due to operator inaccuracy, inexperience or misreading blood tests, a claim can be considered and we can provide specialist advice on medical/clinical negligence.

We get the answers needed and the compensation deserved

Compensation in these cases can include the extra costs associated with caring for a child with a significant disability, which can include both mental and physical disabilities. In these types of cases the aim of compensation is to provide financial compensation for the disabled person, as long-term care is normally required.

If you or your child have been left with a birth injury and you would like to bring a claim, there are strict limit periods.  In general you have three years from the date of the injury in which to issue court proceedings but in the case of a child the three year period does not start until the child reaches age 18.  If the person lacks mental capacity, time does not run against that person all the time that they lack capacity.
