Simon joined Swain and Co Solicitors in March 2016 as a Prison Law Advocate. Simon specialises in Oral Hearings before the Parole Board and represents clients on a whole manner of different sentences including Life Sentence Prisoners, prisoners serving an indeterminate sentence for public protection (IPP) and also extended determinate sentence prisoners eligible for early release through the Parole Board. Simon also assist those who have been recalled to custody whilst on licence within the community. As part of his role with the practice, Simon travels nationwide in order to help those who require assistance.
During his time at Swain and Co Solicitors Simon has been able to secure release for clients on a number of occasions, even when the Probation Service do not recommend their release or the prisoner has not served a period of time in open conditions. Simon is known by members of the Parole Board for his direct questioning of the Probation Officers and Prison Staff in an effort to secure the best possible outcome for his client. He also prides himself on being able to establish a good working relationship with all clients in an effort to make sure that instructions are clear in all cases.
Aside from specialising in Oral Hearings, Simon has also forged links with other projects and agencies in an effort to ensure that Justice is seen to be done to all those he represents. Simon has attended annual meetings for both the JUSTICE group and also the Joint Enterprise Not Guilty by Association (JENGbA) organisation. He also attends the Greater Manchester Law Centre on a fortnightly basis in attempt to provide legal assistance in the fields of Prison Law, Appeals against Conviction or Sentence and Judicial Reviews.
Simon also has a particular interest in providing representations before the Parole Board for those prisoners who are deemed vulnerable through mental health issues or for those who are unable to obtain representation in advance of their hearing. Simon is currently working with the Parole Board directly in this area to draft new guidance on this area of law and hopes to make legal assistance more available for all prisoners in the future.
Away from work Simon enjoys spending time with his family and watching his beloved Aston Villa.
