We are proud members of APIL (the Association for Personal Injury Lawyers) and are pleased to support their campaign to raise awareness that personal injury lawyers make a difference to the lives of people who have been injured through no fault of their own.

In more recent times, and with the advent of ‘no win no fee’ funding, personal injury lawyers have been accused of being ‘ambulance chasers’ and for promoting a ‘compensation culture’. Lawyers responded alleging these stories are due to lazy journalism, fuelled by various Governments attempts to blame the Legal industry for all manner of problems – perhaps for political gain.

The new campaign by APIL seeks to redress the balance and show very clearly how personal injury lawyers can make a real difference to the lives of those who are injured in an accident that was not their fault or as a result of medical negligence.

One fact that the popular press often neglects to focus on is that behind these claims are real people, people that need help navigating what happens next in their lives at a time when they are injured, maybe frightened for their future health, the financial future of their family.  They also, rather conveniently, fail to mention that when a defendant insurer is notified of a potential claim, that insurer must notify the Compensation Recovery Unit (CRU) at the Department for Work & Pensions – to check whether the claimant has received any state benefits that will must then be repaid and offset against parts or all of the eventual award for compensation.

In recent years, the number of claims during the height of the so-called ‘compensation culture’ did in fact reduce year on year – rather than increase. This was thought to be largely due largely to legislation making workplaces safer, as well as to changes regarding the recoverability of legal costs.

Swain & Co are just one of the many firms who are passionately fighting for the rights of those injured as a result of an accident or medical negligence.  Our Clients, many of whom have sustained catastrophic injuries, found our legal knowledge, expertise and support to be invaluable. Indeed, we can and will help co-ordinate – with the NHS and also the private sector - the current and future medical needs and treatment that the Claimant will require. In the case of accident claims we can also organise any adaptations that may be required to the Claimant’s home (and car), or if necessary to move to a new home (or buy a new car) that is more suitable. We seek interim payments – where necessary and will help our clients’ to get back on their feet if their jobs and livelihoods have been affected.

Clients are comforted by the fact that we are there to assist them with many other aspects of their lives, such as the way in which large amounts of damages are paid, how to cope with bills and mortgage payments that might continue to cause anxiety when they are unable to work as a result of injuries.  We always show genuine empathy with our clients.

It must be remembered that when Lawyers secure compensation for their clients, the Claimant is being put back in the same position that they would have been – had they not sustained their injuries. It is a common misconception – especially with larger settlements – that the Claimants are receiving a windfall or ‘lottery pay-out’. This could not be further from the truth. For example,  a headline stating that a 15-year-old claimant with cerebral palsy (caused by failings at the hospital where they were born) was awarded £11 million in damages might seem like the claimant has hit the jackpot, when in fact the compensation is to pay for expensive adaptations required to the home, as well as the cost of future care for the rest of the Claimant’s life.

If someone has made a medical mistake or caused an injury that has life-altering consequences, it is absolutely right that they should be properly compensated.
