Experienced Lawyers Who Handle Birth Abnormalities Claims

Birth abnormalities can occur due to complications which arise prior, during and after birth.

These problems may result in temporary or permanent injury to a baby. In some cases there is also injury to the mother. It is sometimes possible to make a medical negligence claim when an abnormality has been ‘missed’ by healthcare professionals.

Birth abnormalities can be described as an abnormality present at birth which results in physical or mental disability. These can include but are not limited to, problems with limbs, heart and spinal cord. Other abnormalities commonly observed include those affecting the face such as cleft lip and palate.

The use of sophisticated ultrasound scanning has made the detection of birth defects prior to delivery a lot easier but this is dependent upon the ultra-sonographer performing the scan correctly.  If performed correctly it can detect many abnormalities before birth.

Some of the cases of our clients

  1. A devastated mother instructs us after the birth of her child was mismanaged and led to a 25-30 minute delay in performance of a C-section. Sadly, her baby suffered significant neurological symptoms affecting their daily living and requires lifetime care
  2. The mother of a disabled child contacts us after the final stages of her pregnancy were mismanaged. Devastatingly, her baby's brain was starved of oxygen (hypoxic ischaemic encephalopathy). The child has Cerebral Palsy (spastic quadriplegia) with dystonic postering and developmental delay. The child will never live independently, and will be wholly dependent on others for daily care.

We are here to help you and your family

Compensation in these cases can include the extra costs associated with caring for a child with a significant disability, which can include both mental and physical disabilities. In these types of cases the aim of compensation is to provide financial compensation for the disabled person, as long-term care is normally required.
